Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Pebi mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Pebi is a location-based travel documentation app that allows users to:

• Capture and verify photos at famous landmarks worldwide
• Build personal collections of visited landmarks organized by country and location
• Earn achievements based on landmark visits
• Follow other travelers and share experiences through a social feed
• Customize a personal avatar

The App requires location access to verify your physical presence at landmarks and camera access to capture photos.

2A. Eligibility

You must be at least 13 years old to use Pebi. If you are under the age of digital consent in your country, you may use Pebi only with the consent of a parent or guardian. We close accounts we find to be under 13.

3. Account Registration

To use Pebi, you must create an account using Apple Sign In or Google Sign In. You agree to:

• Provide accurate account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

4. User Content

Ownership

You retain ownership of all photos and content you create through the App. By uploading content you grant Pebi a non-exclusive, worldwide, royalty-free licence to host, store, resize, re-encode and display that content in order to operate the App, and to compose it into share cards. If you create a share link, you additionally authorise us to publish that postcard, or your postcard stack, on a public web page at pebi.me that anyone with the link can open, until you stop sharing it or delete the content. This licence exists only to run these features, ends when you delete the content or your account, and we never sell your content or license it to advertisers.

Content Standards

Pebi has no tolerance for objectionable content or abusive users. Content that breaks the standards below is removed, and the account that posted it is suspended or closed. Users who harass, threaten or abuse others are removed from Pebi.

You agree not to upload content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Violates the rights of others, including intellectual property rights
• Contains explicit or inappropriate material
• Is fraudulent, deceptive, or misleading
• Attempts to impersonate another person or entity

Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, and to suspend or close the account that posted it. When we remove content, restrict its visibility or suspend an account, we tell the account holder what we did, why, whether automated tools were involved, and how to contest it. If you disagree, write to support@pebi.app within six months and a person who was not involved in the original decision will review it. If we were wrong, we restore the content. We suspend, and then close, accounts that repeatedly post content breaking these Terms, taking into account how serious and how frequent the breaches are. Where the law requires it, we report illegal content and the associated account information to the competent authorities, including child sexual abuse material, which we report to the relevant reporting body and to law enforcement. 4A. Reporting content

Anyone can report a postcard or account from inside the App, or by writing to support@pebi.app with a link to the content and a short explanation of why you believe it is illegal or breaks these Terms. We confirm receipt, review every report, and aim to decide within 24 hours. We tell the reporter the outcome and tell the person who posted the content why it was removed.

5. Location Verification

Pebi uses your device's location to verify physical presence at landmarks. You agree:

• Not to spoof, fake, or manipulate your location data
• Not to use VPNs, GPS spoofing tools, or other means to falsify your location
• That location verification is provided on an "as-is" basis and may not always be perfectly accurate

Accounts found to be using location manipulation may be suspended or terminated.

5A. Your safety

Pebi asks you to be physically present at a landmark, but never asks you to enter a dangerous, restricted or private place. Obey local laws, signage and traffic rules, do not use the App while driving, and do not trespass. You are responsible for your own safety while capturing photos.

6. Prohibited Uses

You may not:

• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scrapers) to access the App
• Harass, bully, or intimidate other users
• Create multiple accounts to circumvent bans or restrictions
• Reverse engineer, decompile, or disassemble any part of the App

You may not use the App if you are located in a country subject to a US Government embargo or designated as a terrorist-supporting country, or if you are on any US Government list of prohibited or restricted parties.

7. Intellectual Property

The App, including its design, features, code, and branding, is the property of Pebi OÜ. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

If you believe content in Pebi infringes your copyright or trade mark, write to info@pebi.app identifying the content, the right you hold and your contact details. We act on valid notices and tell the person who posted the content, who may reply to us.

8. Third-Party Services

The App integrates with third-party services including:

• Apple Sign In: Subject to Apple's terms and privacy policy
• Google Sign In: Subject to Google's terms and privacy policy
• Cloud Storage: For secure photo storage

We are not responsible for the practices of third-party services.

9. Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App or by contacting support@pebi.app. Upon deletion, your personal data and photos will be permanently removed in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• Location verification will always be accurate
• Landmark data will be complete or up to date
• The App will meet your specific requirements

11. Limitation of Liability

To the maximum extent permitted by law, Pebi OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App, including but not limited to loss of data, loss of profits, or damages arising from reliance on landmark or location information.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under the mandatory consumer law of your country of residence. If you are a consumer in the EU, you keep the protection of the mandatory rules of your own country and may bring proceedings in its courts.

12. Indemnification

You agree to indemnify and hold harmless Pebi OÜ from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Estonia, unless otherwise required by applicable consumer protection laws in your jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App. We will give at least 30 days' notice in the App before a material change takes effect, and you may close your account before then if you do not accept it.

17. Apple App Store

These Terms are between you and Pebi OÜ only, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Pebi OÜ, not Apple, is responsible for addressing any claim relating to the App, including product liability, legal compliance and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where Apple's Licensed Application End User Licence Agreement and these Terms conflict, Apple's agreement prevails.

18. Contact point under the Digital Services Act

For the purposes of Articles 11 and 12 of Regulation (EU) 2022/2065, Pebi OÜ designates support@pebi.app as its single point of contact for users, and for Member State authorities, the European Commission and the European Board for Digital Services. Communications may be in Estonian or English.
